  • 1. Acceptance of Privacy Policy

    Solarhood respects your privacy and recognizes the importance of protecting Information (defined in Section 3 below) collected about you. The defined terms in this Privacy Policy have the same meaning as in the Solarhood Terms of Use (“Terms”), which you should read together with this Privacy Policy. By clicking the Accept Terms of Use and Privacy Policy box on the Solarhood Site you accept and consent to the terms of this Privacy Policy and agree to be bound by it and the Terms. If you are accepting this Privacy Policy on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to the terms of this Privacy Policy, and, in such event, “you” and “your” will refer to that company or other legal entity. This Privacy Policy describes how Solarhood collects, uses, shares, retains, disposes, protects, and discloses Information about you.
  • 2. Changes to Privacy Policy

    Solarhood reserves the right, in its sole discretion, to modify or change this Privacy Policy at any time. Any changes will be effective as of the “Last Updated” date at the top of the Privacy Policy. We may provide you with advance notice of a major change prior to your access of any portion of the Site for which registration is required. For example, we may (i) require that you reaccept the updated version of the Terms or the Privacy Policy, (ii) send you an electronic notification advising of the update to the Privacy Policy, (iii) include a notice on the Site viewable without login advising of the update to the Privacy Policy, and/or (iv) advise you of the updated Privacy Policy during a phone call. We do not ordinarily provide advance notice of a minor change.
  • 3. Collecting Information

    Solarhood collects information by which you may be personally identified, such as name, address, email address, telephone number, other contact information, and other information you provide to us ("Personal Information"). Solarhood collects this information directly from you when you voluntarily register to use the Solarhood Site and Services. Solarhood may also use cookies and other tracking technologies which automatically collect information other than Personal Information including IP addresses, browser type, operating system, and page viewing history (“Technical Information”). Solarhood uses such Technical Information to provide and improve the Services and Site functionality such as recognizing you when you login, improving performance, and analyzing use of the Site. Solarhood may also obtain information from other sources, including third party contractorS, third-party service providers and public information about you (“Other Information” and when used with “Personal Information” and “Technical Information”, collectively “Information”). We may combine the sources of your Information and we may aggregate it with other users’ Information.
  • 4. Using and Sharing Information

    Solarhood uses and shares your Information to provide and enhance the Solarhood Site and Services, including without limitation, communicate with you by phone, regular mail or email; provide you with information you request; perform the Solarhood obligations; enable the communication between you and a third party contractor; enforce the Solarhood Terms; and otherwise for everyday business purposes. If you request an RFI, Solarhood may provide your Information to third party contractors for the purpose of discussing the installation of solar panels or other services, and marketing other products and services. Third party contractorare independent contractors, are not owned or controlled by Solarhood, and Solarhood is not responsible for their acts or omissions. Any use of your Information by a third party, including a third party contractor, is governed by the privacy policy of such third party, and Solarhood disclaims any liability for the acts or omissions of such third party. Please remember that the Privacy Policy only applies to the Solarhood website. This website may contain links to other third party sites that are provided solely for your convenience and information. Solarhood does not control the privacy policies or practices of these third party websites and is not responsible for the content or practices of any linked websites. You should review those policies before providing any personal information. Solarhood may also disclose your Information to third parties when we reasonably believe disclosure is required or appropriate to comply with applicable law, regulation, or legal process or to protect the rights, property, safety, or security of Solarhood, B&V, or others. In the unlikely event B&V or any part of B&V is sold or merged, the Information may be among the transferred assets.
  • 5. Protecting Information

    While no service is completely secure, Solarhood employs managerial, administrative, physical, technical, electronic, and contractual safeguards to protect your Information from loss, unauthorized access or use, disclosure, or alteration. All electronic Information is stored on secure servers behind firewalls by Solarhood or Solarhood’s third party cloud computing service providers. Please be advised that no security procedures, controls, or systems are infallible. SOLARHOOD DOES NOT GUARANTEE THE SECURITY OR CONFIDENTIALITY OF YOUR INFORMATION AND DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES, DUTIES OR CONDITIONS IN THAT REGARD.
  • 6. Retaining and Disposing Information

    Solarhood generally retains Information for so long as we have a legitimate business need for the Information or we are required or it is appropriate to retain the Information to comply with applicable law, regulation, or legal process. We may retain your Information for an indefinite period, but at a minimum for the duration of your use of the Solarhood Site or Services. Solarhood employs Information disposal practices that are reasonable and appropriate to prevent unauthorized access to or use of Information and in accord with the Federal Trade Commission’s “Disposal Rule.” For additional information on the Disposal Rule, please visit: www.ftc.gov
  • 7. Children

    No part of the Site or Services is designed or directed to children. To use or provide personally identifiable information through the Site or Services you must be at least eighteen (18) years of age. If you are under 18, please do not send Solarhood any information about yourself, including your name, address, telephone number, or email address.
  • 8. Correcting Your Personal Information

    Should you wish to update, correct, or otherwise manage any Personal Information you have provided through the Site or Services, you may do so by sending an email to solarhood@bv.com.
  • 9. Governing Law and Dispute Resolution

    Solarhood is located in Kansas, U.S.A., and this Privacy Policy will be governed by Kansas law without regard to any conflict of law principles. You acknowledge and agree that the use and transmission of your Information may occur within and/or outside of the U.S.A., including in jurisdictions that may have less protective data protection laws than the region in which you are situated, and that your Information may be stored and processed manually and electronically through global systems and tools for the purposes described in this Privacy Policy. The parties submit to the jurisdiction of and agree that all claims and disputes arising out of the Privacy Policy shall be submitted to and resolved by binding arbitration in Kansas City, Kansas pursuant to the rules of the American Arbitration Association, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration award may be entered in any court having jurisdiction thereof. Either you or Solarhood may seek any interim or preliminary relief from a court of competent jurisdiction necessary to protect the rights or property of you or Solarhood pending the completion of arbitration.
  • 10. Consent to Contact; Limit or Opt-Out of Communication or Services

    By using the Site or Services, you expressly consent to be contacted by us, our agents, and Third Party Installers using any of the contact methods you have provided us, including by prerecorded or artificial voice messages, text messages, emails, or automatic telephone dialing systems, regardless of whether you incur charges as a result of the communication. You may subsequently elect to limit the method of communication or choose not to receive additional services, information or communication from Solarhood in several ways. You may contact us as indicated in Section 11. You may follow the unsubscribe instructions in an e-mail sent from us. You may request on a call from us that we not call your phone number. Please note any such preference change may take up to 14 days to become effective. Once your Information has been sent to a Third Party Installer, you must communicate with each Third Party Installer to change, limit or discontinue communication, information or services from them.

  • 12. Your California Privacy Rights

    California Civil Code Section 1798.83 permits customers of Solarhood who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please write to us at the Black & Veatch address noted in Section 11.
  • 13. California Do Not Track Disclosure

    Do Not Track is a privacy preference that users can set in their web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user.
